Second Annual National False Claims Act and Qui Tam Trial Institute
Description of Proceedings
As the number of False Claims Act cases filed, and settled, continues to rise, an increasing number of cases
are litigated through discovery and trial. This one-of-a-kind Institute will focus on the unique, and often little understood, discovery, evidentiary and trial challenges that the parties must negotiate to successfully litigate and try a False Claims Act case. Working from a hypothetical fact pattern, a faculty consisting of experienced trial attorneys will explore the strategic, tactical and practical aspects of successfully litigating FCA cases. The capstone of this one of a kind program will be a two-day mock FCA trial, from voir dire through jury deliberations, which attendees will be able to observe live and via video. Attendees of this program will improve their knowledge and understanding of the novel challenges involved in litigating a False Claims Act case, including the following:
- Developing Trial Themes and a Litigation Plan
- Obtaining Discovery from the Government
- Building or Limiting Damages
- Mounting and Defending Daubert Challenges
- E-Discovery Management
- Jury Selection, from using mock jury through voir dire
- Openings and Closings
- Direct and Cross Examination
- Assessing and Reducing the Risk of Exclusion
Program attendees will gain knowledge, understanding and insights that will improve their ability to develop — and present to their clients — a viable plan for successfully litigating and trying an FCA case.
