Background:

Geoffrey Berg practices in the area of commercial litigation, including Internet and technology matters. His past experience includes:

  • Serving as lead counsel for Plaintiffs in a five state class action against SBC Communications, Inc. and related entities. The Plaintiffs sued for issues related to SBC's provision of DSL service. After three and a half years, the case settled in 2003-04 for over $5,600,000.00. McLaughlin, et al. v. SBC Communications, Inc., et al. was covered widely throughout the country including by publications such as the New York Times, the Wall Street Journal, USA Today and others.
  • Representing a central Texas plant worker injured while opening a gate at his worksite. The potential defendants settled for twelve times the injured worker's medical bills without ever filing suit.
  • Defending a Houston-based shipping company in Federal District Court in the Southern District of Texas in a breach of contract claim. The Plaintiff claimed that the Defendant had caused a large shipment of denim to be lost in transit. The suit was dismissed over the Plaintiff's objection prior to trial.
  • Representing a candidate for Texas' First Court of Appeals in a mandamus proceeding before the Supreme Court of Texas. The Democratic Party had refused to certify Jim Sharp's candidacy and informed him that he would not be placed on the ballot. Despite opposition from the incumbent First Court of Appeals justice, the Supreme Court held that the party was obliged to certify Sharp's candidacy and place him on the ballot. See In Re Jim Sharp, 186 S.W.3d 556 (Tex. 2006).
  • Representing an online aeronautical educational company in a suit to dissolve a joint venture. The client had been sued for dissolution and responded by filing a counterclaim. Less than two months after the counterclaim had been filed, the plaintiff agreed to settle by paying the company a confidential sum.
  • Defending two individuals and a corporation in a multi-million dollar breach of contract case in Federal District Court in the Northern District of Texas. The case was dismissed based on defense motions and without payment to the plaintiff.
  • Representing a Lutheran minister accused of possession of child pornography. Based on defense motions, the evidence was suppressed.
  • Representing a nursing home patient against a large health care institution which resulted in a favorable confidential settlement.
  • Representing a Houston radio station as defendant in a slander/libel suit in which the case was dismissed with prejudice, without payment to the plaintiff.
  • Representing an east Texas ready mix concrete business in a complex antitrust action which resulted in a confidential settlement following the sanction of the defendants in the amount of $25,000.
  • Representing a group of plaintiffs who alleged sexual molestation at the hands of a south Texas priest which settled for a confidential amount and included a public apology by the church to the plaintiffs.
  • Assisting in the representation of a group of plaintiffs who had invested millions of dollars in a well known hotel chain and which settled for a confidential amount.
